This policy explains what Third Loft Marketing does with personal information collected through thirdloft.com and through the services we provide to clients. If anything here is unclear, email team@thirdloft.com and we will answer plainly.

Who we are

Third Loft Marketing is a digital marketing agency registered in Grand Junction, Colorado. We build websites and run SEO and marketing campaigns for businesses across the Grand Valley. For anything to do with this policy or your information, contact us at team@thirdloft.com or 970-822-0735.

What we collect

Information you give us. When you fill in a form, email us, call us or book a call, we collect your name, business name, email address, phone number and whatever you choose to tell us. Forms on this site are provided by YouForm, and submissions are passed into our CRM, HighLevel (Go High Level), where we manage enquiries and client communication.

Information collected automatically. This site runs on WordPress and is hosted with Cloudways. Like any web host, Cloudways keeps standard server logs that record IP addresses, browser and device type, pages requested, and referring pages. We use this for security and to understand how the site is used.

Client account data. If you hire us, we are given access to systems that belong to you, such as your website, Google Business Profile, analytics and advertising accounts. We use that access only to carry out the work you have asked for, and we hand it back at the end of an engagement.

We do not knowingly collect information from children, and this site is not directed at anyone under 16.

Text messages and mobile information

We send text messages through HighLevel. You will only receive them if you gave us your mobile number and agreed to be contacted that way, for example by ticking the consent box on a form, replying to a message, or asking us to text you. Consent to receive text messages is never a condition of buying anything from us.

Messages are about your enquiry or your project: replies to something you sent us, appointment reminders and confirmations, and occasional updates about work in progress. Message frequency varies and depends on your conversation with us. Message and data rates may apply.

Reply STOP to any message to opt out, and you will receive one confirmation that no further messages will be sent. Reply HELP for help, or contact us on 970-822-0735 or at team@thirdloft.com. Carriers are not liable for delayed or undelivered messages.

How we use your information

We use what we collect to reply to your enquiry, to quote for and deliver the work you have asked for, to send service messages such as appointment confirmations and invoices, to keep the site secure and working, and to meet our legal and accounting obligations. We do not sell personal information, and we do not share it with other companies so they can market to you.

Who we share it with

We use a small number of service providers who process information on our behalf, under contract, and only for the purposes we set. They are:

• HighLevel (Go High Level): our CRM. Holds enquiry and client contact records, and sends our email and text messages.
• YouForm: the forms on this site. Captures what you type and passes it to us.
• Cloudways: hosting for this WordPress site, including server logs and backups.

We will also disclose information if the law requires it, or to establish or defend a legal claim. Beyond that, we do not pass your details on. As stated above, text messaging opt-in data and consent are never shared with anyone.

Cookies and analytics

WordPress sets a small number of functional cookies, for example to remember that you left a comment or that you are logged in as an administrator. Forms and embedded content from the providers listed above may set their own cookies when you interact with them.

Your rights

Under the Colorado Privacy Act, Colorado residents can ask us to confirm what personal data we hold about them, to correct it, to delete it, and to provide a portable copy. You can also opt out of targeted advertising, the sale of personal data, and profiling that produces legal or similarly significant effects. We do not sell personal data or use it for profiling of that kind.

To exercise any of these, email team@thirdloft.com. We will respond within 45 days, and may extend once by a further 45 days where the request is complex, telling you why. If we refuse a request you may appeal by replying to our decision, and we will respond to the appeal within 45 days.

Where we act as a service provider to a client, for example handling data inside a client’s own CRM or advertising account, the client controls that data and requests should go to them. We will help them answer you.

Security, retention and changes

This site is served over HTTPS, access to our CRM is restricted to people who need it, and we use multi-factor authentication where the tools support it. No method of transmission or storage is completely secure, so we cannot promise absolute security.

We keep enquiry records for as long as we may reasonably need them to answer follow-up questions, and client records for as long as our engagement lasts plus the period our accountants and the law require. You can ask us to delete your information sooner and we will unless we are required to keep it.
