Terms and Conditions

Last updated 25 July 2026

These terms cover your use of thirdloft.com. Client work is governed by the separate written agreement we sign with you. Where the two disagree, that agreement wins.

Using this site

You may read, print and share the pages on this site for your own purposes. You may not copy the site wholesale, scrape it for a competing service, or represent our work as your own.

We try to keep everything here accurate, but the site is provided as it is. Prices shown are indicative base rates, not offers, and the scope of any actual engagement is set out in a written proposal.

When you submit a form on this site you are asking us to contact you about your enquiry. What we do with those details is set out in our Privacy Policy.

Engagements and quotes

A proposal from us is valid for thirty days unless it says otherwise. Work begins when the proposal is accepted in writing and any deposit is received.

Ongoing programs run month to month. Either side can end them with thirty days’ notice, and we will not hold your accounts, files or access hostage on the way out.

Build projects are quoted as a fixed scope. Changes to that scope are quoted separately before they are started, so you will never receive an invoice for work you did not agree to.

We rely on you to supply content, access and feedback in reasonable time. Where a project stalls waiting on your side for an extended period, we may pause it and reschedule the remaining work around our other commitments.

Fees and payment

Fees, deposits and the invoicing schedule are set out in your proposal.

Advertising budgets are separate from our fees. Where you ask us to run paid campaigns, media spend is billed to Third Loft directly then collected from you, in arears. Third-party subscriptions such as hosting, premium plugins or software licences are also separate, and we will tell you before committing you to any of them.

Text messages

By giving us your mobile number and agreeing to be contacted by text, you consent to receive text messages from Third Loft Marketing relating to your enquiry or your project. That includes replies from us, appointment reminders and confirmations, and updates on work in progress. Consent is not a condition of purchase.

Message frequency varies. Message and data rates may apply. Reply STOP at any time to opt out, and HELP for help. Carriers are not liable for delayed or undelivered messages. Our messages are sent through HighLevel, and how we handle your mobile information is set out in the Privacy Policy.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties.

In instances where we set up or run text messaging on your behalf as a client, you remain responsible for the consent you have collected from your own contacts, and for the accuracy of the business information used to register your A2P 10DLC campaign. We will not send messages to a list you cannot show consent for.

Ownership

On final payment, you own the website, the content we produced for you, and every account created on your behalf. We keep the right to show the work in our portfolio and to describe what we did, unless you ask us not to.

We will assist in migration if you opt to take your website to a different provide or host it in house, however, we recommend notifying us that this is your attention in advanced migration may take longer without this knowledge.

Third-party assets such as fonts, stock imagery, themes and plugins remain under their own licences, which we will pass to you at handover. Our own internal tooling, templates and processes remain ours.

Third-party services

Our work depends on platforms we do not control. This site runs on WordPress and is hosted with Cloudways, our forms are provided by YouForm, and our CRM, email and text messaging run on HighLevel. Search rankings, map placement and advertising delivery are controlled entirely by Google, Meta and other platforms.

We are not responsible for outages, policy changes, account suspensions, price rises or feature removals at any of these providers. Where something breaks because a platform changed, we will tell you what happened and what it will take to put right.

Liability

We are responsible for doing our work competently. We are not responsible for outcomes outside our control: changes to search engine or advertising platform behaviour, third-party outages, or actions taken on your accounts by other parties.

We do not guarantee particular rankings, lead volumes or revenue. Anyone who does is guessing. To the extent the law allows, our total liability in connection with any engagement is limited to the fees you paid us for the work in question, and neither side is liable for indirect or consequential loss.

Governing law

These terms are governed by the laws of the State of Colorado, and any dispute will be handled in the courts of Mesa County. If any part of these terms is found unenforceable, the rest continues to apply.

We may update these terms. The date at the top shows when they last changed. For questions please contact team@thirdloft.com or 970-822-0735.
